There being no objection, it was so ordered. Amendment No. 1 was offered by Representative Kelly: Page 1, line 2 (title amendment): Delete "police officer, a village public safety officer," Insert "peace officer" 1998-02-06 House Journal Page 2244 HB 334 Page 1, lines 6 - 7: Delete "members of the armed services, a fire department, or the police." Insert "a peace officer or members of the armed services or a fire department. (a)" Page 1, line 10, following "was": Insert "(1)" Page 1, line 11, through page 2, line 1: Delete "services, a fire department, the state troopers, the village public safety officers program, or a municipal police department and who died in the line of duty or who died as a result of injuries sustained while in the line of duty for the municipal, state or federal government or fire department, or who was listed by the United States Department of Defense as a prisoner of war or as missing in action. In this section," Insert "services and who died in the line of duty or who died as a result of injuries sustained while in the line of duty for the state or federal government or who was listed by the United States Department of Defense as a prisoner of war or as missing in action; or (2) a peace officer or a member of a fire department who died from an act arising out of and in the course of (A) employment as a peace officer or a fire fighter; or (B) duties as a volunteer fire fighter. (b) In this section," Page 2, lines 5 - 6: Delete "member of the armed services, a fire department, the state troopers, the village public safety officers program, or a municipal police department at the time of the" Insert "peace officer or of a member of the armed services or a fire department at the time of the peace officers or" Page 2, line 8, following "the": Insert: "peace officers or" 1998-02-06 House Journal Page 2245 HB 334 Page 2, lines 10 - 11: Delete "state trooper, village public safety officer, or municipal police officer" Insert "or peace officer" Page 2, line 12, following "the": Insert "peace officers or" Page 2, line 13, following "the": Insert "peace officers or" Page 2, line 14, following "the": Insert "peace officers or" Page 2, lines 18 - 19: Delete "and includes acts arising out of and in the course of employment" Page 2, following line 19: Insert a new paragraph to read: "(5) "peace officer" has the meaning given in AS01.10.060 and includes a correctional officer;" Renumber the following paragraph accordingly. Page 2, lines 21 - 22: Delete "a fire department, the state troopers, the village public safety officers program, or a municipal police department" Insert "in a fire department, or as a peace officer" Page 2, line 24, following "records": Insert "; (7) "spouse" means a person who was married to a peace officer or to a member of the armed services or a fire department at the time of the peace officers or members death" Page 2, line 27, following "duty": Insert "or who died from an act arising out of and in the course of employment or duties as a volunteer fire fighter" 1998-02-06 House Journal Page 2246 HB 334 Representative Kelly moved and asked unanimous consent that Amendment No. 1 be adopted. Representative Kubina objected and withdrew the objection. There being no further objection, Amendment No. 1 was adopted and the new title appears below: CS FOR HOUSE BILL NO. 334(FIN) am "An Act relating to waiver of tuition and fees for certain family members of a peace officer or a fire fighter killed in the line of duty; and providing for an effective date." Representative Porter moved and asked unanimous consent that CSHB 334(FIN) am be considered engrossed, advanced to third reading and placed on final passage. There being no objection, it was so ordered. CSHB 334(FIN) am was read the third time. Representative Ogan moved and asked unanimous consent that he be allowed to abstain from voting due to a conflict of interest. Objection was heard, and Representative Ogan was required to vote. The question being: "Shall CSHB 334(FIN) am pass the House?"
